Policy

We take the protection of your personal data very seriously and treat your personal data as confidential in accordance with legal data protection regulations as well as this data privacy statement.

The purpose of this data privacy statement is to provide you with information about the nature, extent and purpose of the collection and use of personal data by the website operator Heinrich Eibach GmbH.

Because this data privacy statement may be modified due to new technologies and the ongoing development of this website, we recommend that you reread the privacy policy on a regular basis.

Please refer to Art. 4 GDPR for definitions of the terms used (e.g. “personal data” or “processing”).

We would also like to take this opportunity to inform you of your rights as a data subject. These rights are standardised in Art. 15-22 EU GDPR. They include:

  • The right of access (Art. 15 EU GDPR),
  • The right to erasure (Art. 17 EU GDPR),
  • The right to rectification (Art. 16 EU GDPR),
  • The right to data portability (Art. 20 EU GDPR),
  • The right to restriction of processing (Art. 18 EU GDPR),
  • The right to object (Art. 21 EU GDPR).

Please contact: datenschutz(at)eibach(dot)de to exercise your rights or if you have questions about data processing in our company. You also have the right to lodge a complaint with a data protection supervisory authority.

Purposes and legal basis of data processing

The provisions of the EU‑GDPR and all other applicable provisions regarding data protection law are complied with in the processing of your data. The legal basis for data processing is taken in particular from Art. 6 EU GDPR.

We use your data to initiate business, fulfil contractual and statutory obligations, implement contracts, provide products and services and to strengthen the customer relationship, which may also include analysis for marketing purposes, customer satisfaction surveys and direct advertising.

Your consent also fulfils the consent requirement under data protection law. We hereby clarify the purposes of data processing and your right to withdraw your consent. If special categories of personal data are processed based on consent, we will expressly state this in the consent form.

Special categories of personal data within the meaning of Art. 9(1) EU GDPR are processed only where necessary due to legal regulations and there is no reason to believe that such regulations are outweighed by your legitimate interest in precluding processing.

Collection of personal data during use of the website

Our website generally cannot be used without the provision of personal data. Where personal data (such as name, address or e-mail addresses) is collected on our website, this is done on a voluntary basis as far as possible. This data is not shared with third parties without your explicit consent.

Please note that the transmission of data over the internet (e.g. communication via e-mail) can have security holes. There is no way to completely protect data from access by third parties.

Data deletion and storage period

The personal data of data subjects is deleted or blocked as soon as the purpose of storing it no longer applies or the data subject logs out. Data may continue to be stored if the data controller is subject to a retention requirement under European or national law in regulations, laws or other provisions within Member States of the EU. Data will also be blocked or deleted when the storage period prescribed by the norms above expires, unless it is necessary to continue storing the data for the purposes of concluding or fulfilling a contract.

Sharing data with third parties

We only share your data with third parties where required by statutory provisions or with your corresponding consent. Otherwise, data is not shared with third parties unless compelling legal reasons to do so exist (sharing with external bodies such as supervisory authorities or law enforcement).

Data recipients/categories of recipients

Within our company we ensure that only the persons who need your data to fulfil contractual and legal obligations have access to it.

In some cases, our special departments receive support from service providers to fulfil their tasks, e.g. sending out the newsletter. All service providers have signed the necessary agreements concerning data protection law.

Data transfers to third countries / purpose of data transfers to third countries

Personal data will only be transmitted to third countries (countries outside the European Union or the European Economic Area) where required by law or if you have given us your consent to do so or where necessary to carry out obligations.

Use of cookies

Parts of our website use “cookies”. These serve the purpose of making our offer more user-friendly, effective and secure. Cookies are small text files that are stored on your device and saved by your browser. Most of the cookies we use are what are called “session cookies”. They are automatically deleted when you leave our website. Cookies do not contain viruses or cause damage to your device.

Newsletter

If you would like to subscribe to the newsletter we offer on our website, we will need your e-mail address and information to verify that you are the owner of the e-mail address given and consent to receiving the newsletter.

We use the “double opt-in” method to ensure that you consent to our sending the newsletter. This process adds the potential recipient to a distributor. The user will then receive a confirmation e-mail allowing them to confirm for legal purposes that they wish to subscribe. The user’s e-mail address will only become active in the distributor once this confirmation has been completed.

We will only use this data to send the information and offers requested.

We use the Sendinblue newsletter software. Your data will be transmitted to Sendinblue GmbH. Sendinblue is strictly prohibited from selling your data or using it for purposes other than to send the newsletter. Sendinblue is a verified German provider that was selected according to the requirements of the General Data Protection Regulation and the Federal Data Protection Act. You can find more information here: Information newsletter recipients - Sendinblue

You can withdraw your consent to store data, your e-mail address and the use of it to send the newsletter at any time by clicking the “Unsubscribe” link in the newsletter. Data protection measures are subject to continuous technical improvement. For this reason, we ask that you keep yourself informed of our data protection measures by viewing our data privacy statement on a regular basis.

Material warranty

If you would like to receive the material warranty we offer on our website, we will need your e-mail address and information to verify that you are the owner of the e-mail address given. To offer you the warranty, we will also need information concerning the product, purchase and address.

This data will only be used to issue your warranty certificate, which will then be sent to you if the information given is correct.

Registering for the material warranty will also automatically add you to our newsletter distributor. Please see the “Newsletter” section above for more details. To add: If you unsubscribe within 5 years, your warranty will not be voided. It will remain valid for the rest of the corresponding period. You will continue to receive our newsletter after the material warranty expires until you unsubscribe.

Contest participation via a contact form on the website

If you confirm the data privacy statement for contests when you register, this will include automatic confirmation of the terms of participation. We will also need your e-mail address and information to verify that you are the owner of the e-mail address given.

You can only participate in contests if you are explicitly registered as an active subscriber during the period indicated and the data you provide is correct and complete. You must sign up for each contest separately. Your participation does not automatically count towards future contests once a contest period is over.

If you sign up for a contest via the contact form, the data you provide will be stored for the purpose of processing.

More information on current contests can be found in the terms of participation.

Contact form

If you send us enquiries via the contact form, your information from the enquiry form, including the contact information you provide in the form, will be stored for the purpose of processing your enquiry and in case you have any follow-up questions. We will not share this information without your consent. It will be deleted after your enquiry has been fully processed.

You can withdraw your consent at any time with effect for the future by sending an e-mail to webmaster@eibach.de.

Data privacy statement for the use of Google Analytics

This website uses Google Analytics, a web analysis service of Google Inc. (“Google”). Google Analytics uses “cookies”, text files that are stored on your device and that allow your use of the website to be analysed. The information generated by the cookie about your use of this website will generally be transmitted to a Google server in the United States and stored there. If IP anonymisation is active on this website, however, your IP address will first be truncated by Google if you are in a Member State of the European Union or another Member State of the Agreement on the European Economic Area.

Only in exceptional cases will the full IP address be transmitted to a Google server in the United States and truncated there. Google uses this information on behalf of the website’s operator to analyse your use of the website, compile reports on website activity and to provide other services to the website operator in connection with the use of the website and Internet use. The IP address transmitted by your browser for the purposes of Google Analytics will not be conflated with other Google data.

You can prevent the storage of cookies by making the relevant setting in your browser software; please note, however, that doing so may restrict the functionality of this website. You can also prevent the collection of the data generated by the cookie relating to your use of the website (including your IP address) and its transmission to and processing by Google by downloading and installing the browser plug-in available at the link below: http://tools.google.com/dlpage/gaoptout?hl=de.

More information on this can be found at http://tools.google.com/dlpage/gaoptout?hl=de or at http://www.google.com/intl/de/analytics/privacyoverview.html (general information on Google Analytics and data privacy). Please note that the code “gat._anonymizeIp();” has been added to Google Analytics on this website to ensure that IP addresses are collected in anonymous form (IP masking).

IP anonymisation

We use the function “Enable IP anonymisation” on this website. This means, however, that your IP address will be truncated by Google before transmission if you are in a Member State of the European Union or another Member State of the Agreement on the European Economic Area.

Commissioned data processing

We have a commissioned data processing contract with Google and implement the strict requirements of German data protection authorities regarding the use of Google Analytics.

Browser plug-in

You can prevent the storage of cookies by making the relevant setting in your browser software; please note, however, that doing so may restrict the functionality of this website. You can also prevent the collection of the data generated by the cookie relating to your use of the website (including your IP address) and its transmission to and processing by Google by downloading and installing the browser plug-in available at the link below: https://tools.google.com/dlpage/gaoptout?hl=de

Objecting to data collection

You can prevent Google Analytics from collecting your data by clicking the following link. This will set an opt-out cookie that prevents your data from being collected during future visits to this website: disable Google Analytics

Data privacy statement for remarketing across multiple devices

Our websites use the functions of Google Analytics Remarketing in conjunction with the cross-device functions Google AdWords and Google DoubleClick. The provider is Google Inc. 1600 Amphitheatre Parkway Mountain View, CA 94043, USA.

This function allows the advertising target groups created with Google Analytics Remarketing to be combined with the cross-device functions of Google AdWords and Google DoubleClick. This allows personalised interest-based advertising messages based on your previous use and browsing to be customised for you on a device (e.g. mobile phone) or to be shown to you on another of your devices (e.g. tablet or PC).

If you have given your consent, Google will link your web and app browsing history to your Google account. This will allow the same personalised advertising messages to be shown to you on any device on which you log into your Google account.

Google Analytics collects the user’s Google-authenticated ID to support this function, which is temporarily linked to our Google Analytics data in order to define and create target groups for showing ads across multiple devices.

You can object to cross-device remarketing/targeting permanently by disabling personalised ads in your Google account by clicking the following link: https://www.google.com/settings/ads/onweb/

You can find more information and data protection provisions in Google’s data privacy policy at: http://www.google.com/policies/technologies/ads/

Data privacy statement for the use of YouTube

Our website uses plug-ins of the YouTube site operated by Google. The operator of the site is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. If you visit one of our pages with a YouTube plug-in, a connection to YouTube's servers will be established. The YouTube server will be notified which of our pages you visited.

If you are logged into your YouTube account, this will allow YouTube to attribute your browsing history directly to your personal profile. You can prevent this by logging out of your YouTube account.

More information on the handling of user data can be found in YouTube’s data privacy policy at: https://www.google.de/intl/de/policies/privacy

Contact details in imprint

We hereby expressly object to the use of contact data published as part of our obligation to provide an imprint by third parties for the purpose of sending advertising and informational materials not explicitly requested. The operators of the site explicitly reserve the right to take legal action in the event of unsolicited advertising, such as spam mail.
